1. I concorsi pubblici non richiedono una laurea magistrale, quindi perché laurearsi in L-63, scienze delle pubbliche amministrazioni?
2. LM-52 (relazioni internazionali) offre una specializzazione in un ambito estremamente specifico, dove è difficile farsi spazio, ed in ogni caso è estremamente inflazionata, essendo la scelta di buona parte dei laureati L-36.
3. LM-62 (scienze della politica)? Non ne parliamo. Laurea assolutamente sconosciuta ai più, nessuna reale applicazione al mondo del lavoro, tanto vale laurearsi in filosofia, il livello è quello.

Dall’altra, i corsi magistrali di economia sono floridi di conoscenze reali (diciamocelo chiaramente, gli unici esami seri in scienze politiche sono proprio quelli in ambito economico e giuridico, gli esami nell’ambito SPS sono fuffa…) e sono classi di laurea che aprono praticamente ad ogni professione da incravattato, con ottime prospettive di avanzamento professionale. Inoltre è sempre possibile accedere ai concorsi pubblici (il triangolo sacro della PA è giurisprudenza-scipol-economia).
Viene spesso detto che le lauree economiche siano ormai inflazionate, ma è vero? Piuttosto è inflazionata la L-18 (triennale di economia aziendale), mentre le magistrali sfornano professionisti e si assume (i nullafacenti parcheggiatisi in triennale difficilmente faranno anche una magistrale).
Ma perché LM-77 (economia e management) e non LM-56 (scienze dell’economia) o LM-16 (finanza)?
La risposta è quanto più banale che ovvia, si presuppone che un laureato L-36 (scienze politiche) non abbia gli strumenti necessari per intraprendere un percorso di economia strettamente legato all’utilizzo degli strumenti offerti dalla matematica, insomma in poche parole un corso di laurea dove bisogna fare di conto, e fare di conto seriamente, e questo vale specialmente per LM-16, che pur essendo senza dubbio la classe di ambito economico con più prospettive di carriera, è anche quella più complessa (non a caso spesso i suoi studenti sono triennalisti in matematica, statistica o ingegneria).
E qui l’anello di congiunzione: LM-77, economia e management.
Perché? Ha un curricula dove lo studio quantitativo dell’economia non ha il peso delle sue sorelle, lasciando ampio spazio ad esami di diritto ed esami di ambito “aziendalistico” dove le competenze matematiche necessarie sono decisamente inferiori. LM-77 è poi la laurea per definizione negli ambiti aziendali/dirigenziali, annoverando quelle competenze reali che un corso come LM-56 non offre, essendo strettamente teorico.
E come può quindi il possesso di una laurea L-36 (triennale scienze politiche), regina delle competenze trasversali, non essere un plus sul mercato del lavoro, offrendo, rispetto ad un semplice laureato in L-18 (triennale di economia) anche una conoscenza certificata in ambito sociologico, giuridico, storico?
Ma come siamo messi in Italia per l’ibrido L-36/LM-77?
Il datore di lavoro valuterà il possesso della triennale di scienze politiche come semplice escamotage per fare qualcosa di più semplice rispetto alla triennale di economia, aggirando il sistema?
O valuterà positivamente il possesso di competenze trasversali aggiunte allo stesso grado di preparazione magistrale?

Modifiche agli articoli 72, 73, 77 e 82 della Costituzione, in materia di approvazione di disegni di legge, prerogative delle opposizioni e omogeneità dei decreti-legge

Questo disegno di legge promette bene per vari fattori anche esterni al suo contenuto.
Innanzitutto non è un disegno di legge ‘personale’ presentato da un singolo senatore (tipo questo), ma uno collettivo sostenuto dall’intero gruppo del PD al Senato—ben 37 parlamentari.
Ma, soprattutto, non è nato morto. Non si tratta di un disegno di legge depositato e mai calendarizzato, ma di uno il cui iter è già partito: presentato il 22 dicembre 2023 e assegnato alla Commissione Affari Costituzionali il 13 marzo 2024, ha ricevuto attenzione costante in Commissione con una media di circa due sedute al mese; attualmente si trova in fase di audizioni informali, durante le quali il Parlamento ottiene pareri di esperti e costituzionalisti su come modificare il testo-base.
E che a fare le leggi sia il Parlamento non è solo il cappello introduttivo di questo post. L’averlo ignorato è anche la radice di uno dei più noti problemi dell’ordinamento italiano, che questo DDL punta a correggere: e cioè la proliferazione incontrollata dei decreti-legge.
In Italia, il disegno di legge è il metodo standard, normale, ordinario per avanzare una proposta legislativa. Questo si presenta al Parlamento che lo studia, lo pondera, lo modifica, lo vota e lo approva. Perché a fare le leggi è il Parlamento.
E la Costituzione lo conferma (art. 77 Cost.): «Il Governo non può, senza delegazione delle Camere, emanare decreti che abbiano valore di legge ordinaria». Ciò che ne segue è semmai l’eccezione:

Quando, in casi straordinari di necessità e di urgenza, il Governo adotta, sotto la sua responsabilità, provvedimenti provvisori con forza di legge, deve il giorno stesso presentarli per la conversione alle Camere che, anche se sciolte, sono appositamente convocate e si riuniscono entro cinque giorni.

Questi ‘provvedimenti provvisori con forza di legge’ sono quelli che denominiamo decreti-legge, e risulta abbastanza palese come, dal tono quasi solenne della Costituzione, questi decreti fossero originariamente pensati come arma finale: un’ultima risorsa, uno strumento estremo da adottarsi, appunto, «in casi straordinari di necessità e di urgenza» [cit.].
Ebbene, è il 2024 e ci siamo accorti tutti che ormai non è più così.
Il Rapporto sullo stato della legislazione 2022-2023 è chiaro: prendendo a esempio i primi sette mesi del Governo Meloni (13 ottobre 2022–13 maggio 2023), sono stati emanati 27 decreti-legge (quasi quattro al mese), al punto che le leggi di conversione dei decreti-legge rappresentano il 65,52% del totale delle leggi approvate (p. 21). È evidente che ormai l’opera vera di creazione della legge si è spostata dal Parlamento al Governo, complice anche la lentezza tipica del bicameralismo perfetto (che impone che le due Camere esaminino e approvino il medesimo testo di ogni singola legge).
Che questa cosa non vada bene non è un segreto. La Corte costituzionale stessa, appena un mese fa, si è espressa con termini molto duri (Sent. Corte Cost. 146/2024) all’interno di una sentenza in cui, tra l’altro, dichiara incostituzionale un comma di un decreto-legge dell’anno scorso (D.L. 51/2023, art. 2, comma 3) per palese mancanza dei requisiti di straordinaria necessità e urgenza:

I limiti costituzionali alla decretazione d’urgenza e alla legge di conversione non sono funzionali solamente al rispetto degli equilibri fondamentali della forma di governo, ma valgono anche a scoraggiare un modo di legiferare caotico e disorganico che pregiudica la certezza del diritto.

D’altra parte può sembrar strano che non ci siano dei limiti o delle specificazioni ulteriori a quello che altrimenti resta sì uno strumento cruciale, ma la cui intera essenza è appesa solo a poche righe di descrizione in Costituzione. E infatti non è così: una legge di quasi quarant’anni fa (L. 400/1988) disciplina l’attività di governo, e il suo articolo 15 è interamente dedicato ai decreti-legge.
Qui si stipulano principi importantissimi che ne limitano di molto l’uso, quali ad esempio:

• l’obbligo di indicazione nel preambolo dei motivi di straordinaria necessità e urgenza che ne giustificano l’utilizzo;
• il divieto d’uso per una serie di materie quali quella costituzionale, elettorale, di delega legislativa, di approvazione di bilanci, di autorizzazione a ratificare trattati internazionali;
• la richiesta che le misure introdotte siano di immediata applicazione;
• la richiesta che il contenuto del decreto-legge sia specifico e omogeneo, e che corrisponda al suo titolo.

Ma se le cose stanno così, perché negli ultimi trentasei anni i decreti-legge hanno continuato a non rispettare molti di questi criteri? Perché non si è già risolto tutto?
La risposta è semplice: perché questa è una legge ordinaria, e anche i decreti-legge hanno valore di legge ordinaria. Poiché le fonti hanno lo stesso rango, i decreti-legge posteriori hanno la meglio perché sono più specifici e recenti nel tempo. Non si può efficacemente usare la legge per regolare qualcosa che ha essa stessa forza di legge.
Da qui, l’idea del DDL: inserire quei limiti direttamente in Costituzione—e non solo.
Il primo dei quattro articoli di cui si compone il disegno di legge mira a curare non i sintomi del problema, ma semmai le cause.
Dico così perché il primo articolo del DDL, difatti, riconosce che spesso il Governo agisce con decreto-legge come mezzo per poter attuare il proprio programma: come già detto sopra, l’iter legislativo in Parlamento è quello standard—ma è anche estremamente lento.
Pertanto, al fine di garantire che il Governo possa efficacemente mandare avanti la propria attività anche senza l’uso smodato dei decreti-legge, si vuole modificare l’articolo 72 della Costituzione in modo che, escluse le materie viste sopra per cui la legge vieta già ora i decreti-legge (più poche altre, come le leggi di amnistia e di indulto), il governo possa deliberare di chiedere a ciascuna Camera di iscrivere un proprio disegno di legge con priorità, ossia con un esame da concludersi entro 70 giorni (esteso in 85 per i disegni di legge di particolare complessità).
Ciò renderebbe possibile al Governo di perorare i propri obiettivi senza comprimere del tutto la sovranità del Parlamento. Tuttavia, per tutelare anche i diritti delle minoranze parlamentari, si impone che i regolamenti delle Camere disciplinino le prerogative che i gruppi d’opposizione hanno in merito alle tempistiche, in particolare assegnando loro d’ufficio spazi adeguati nella programmazione e nell’organizzazione dei lavori parallelamente ai disegni di legge prioritari del Governo.
Questo articolo vuole modificare l’articolo 73 della Costituzione, dando a un terzo dei componenti di una Camera il potere di sollevare la questione di legittimità costituzionale di una legge o di un atto avente forza di legge entro trenta giorni dalla sua pubblicazione, senza quindi attendere che la legge sia applicata e che tale questione sorga naturalmente durante un giudizio in tribunale.
Immagino l’idea sia quella di poter agire immediatamente contro i decreti-legge incostituzionali, ora che i limiti al loro uso sono esplicitati direttamente in Costituzione (v. articolo 3 immediatamente sotto).
Si costituzionalizza (all’interno dell’articolo 77 della Costituzione) molto di quanto riportato alla L. 400/1988 di cui sopra sui decreti-legge, e in particolare le parti che impongono:

• che le misure debbano essere di immediata applicazione;
• il carattere specifico e omogeneo del testo;
• l’eccezione di quelle materie vietate.

Ma in aggiunta si limita ulteriormente il loro uso a quattro materie specifiche e tassative, ovverossia: pubbliche calamità (es. la pandemia); sicurezza nazionale; norme finanziarie; adempimento di obblighi UE senza cui lo Stato rischia l’infrazione.
Sempre seguendo il principio della tutela delle opposizioni, e prendendo in prestito dall’articolo 2 il quorum di un terzo dei componenti di una Camera, si modifica l’articolo 82 della Costituzione per far sì che quel numero di deputati o senatori sia sufficiente a istituire una Commissione parlamentare d’inchiesta.
Si chiede poi che le Camere individuino nei propri regolamenti quali sono le Commissioni o le Giunte o gli altri organi che abbiano compiti «ispettivi, di inchiesta, di controllo o di garanzia», cosicché la loro presidenza sia affidata a un membro dell’opposizione (com’è già ora per il COPASIR ad esempio, il Comitato Parlamentare per la Sicurezza della Repubblica).
Questo è quanto. Sicuramente la discussione procederà una volta che agosto sarà concluso, e spero che la legislatura duri abbastanza da poterne vedere un esito positivo; il DDL è stato anche abbinato nel suo esame ad altri tre di cui uno di Forza Italia (S. 574, che vuole allungare da sessanta a novanta giorni il termine imposto alle Camere per la conversione dei decreti-legge), quindi la speranza di un punto di confluenza fra maggioranza e opposizione su un testo che metta d’accordo tutti non è spenta.
E se non altro, anche qualora la proposta non piacesse, è sempre bello vedere un Parlamento attivo anche sulle proposte dell’opposizione, e non solo su quelle della maggioranza. Voi che pensate della proposta?
